Booking & Cancellation Policy

To hold your place on a tour, please choose the “Book Now” menu tab or click the “Book Now” button on each page. You can also call 1-905-399-1216 to make the booking. Whether booking online or over the phone you will pay a deposit of 20%. The final payment is usually taken one or two days before the tour date, once we have checked the weather and know that the tour can run.  Booking one of our activities means you agree with our policies and are willing to sign a waiver prior to participation.

Cancellation Policy Terms and Conditions

These are the Terms and Conditions that will apply to your booking with us.

These Terms shall constitute the entire agreement between Georgian Bay Tours and the Client relating to the subject matter herein, and shall constitute a binding agreement. There is no verbal or written representation, warranty, prior agreement, or description of services, other than as expressed herein.

The contract and booking is made with, and services will be provided by Georgian Bay Tours. By booking a trip, you agree to these Terms and Conditions that govern the relationship, the cancellation policy, and limitations of liability. These Terms and Conditions affect your rights and designate the governing law and forum for the resolution of any and all disputes.

Because our activities have a limited number of spots available, we do have to turn people away once our tours are full. Due to this, we can’t refund or reschedule within 7 days unless a replacement participant is found. If you must cancel we try very hard to find someone to take your spot for you. If we can fill your spot, or for cancellations 7 days or more in advance a refund, less a 10% cancellation fee, will be charged per person. For last-minute cancellations or no-shows, we are unable to offer a refund.

Our cancellation policy must apply even in the event of a medical problem or family circumstance. We will do everything possible to fill your vacant spot for you. In the case of a Force Majeure*, such as but not limited to acts of terrorism, war, pandemics, labour disputes, government actions, strikes, or major adverse weather conditions, all terms and conditions may be subject to change.

We reserve the right to cancel or alter any trip due to weather or insufficient registrations. In these cases, full refunds will be issued. If you have questions email or call us 1-905-399-1216.

Force Majeure Definition

*In the force majeure context, performance of the contract must become impossible; it is not enough that the contract become more onerous, or even significantly more difficult, but still possible to perform. Rather, a party must show that the original purpose of the contract has been frustrated, and it would be unjust for them to be bound to the contract under the existing circumstances.

In a  force majeure, the situation or event that has allegedly frustrated the contract must (1) be unforeseeable at the time the contract was entered into; and (2) not be the fault of either party.
